The Department of Labor and Employment has released Aug. 5 an advisory on the payment of wages for the special nonworking day on Aug. 21, or the Ninoy Aquino Day, and the regular holiday on Aug. 26 for the National Heroes Day.
DOLE Secretary Bienvenido Laguesma, in Labor Advisory 09-24, said that private sector employees who render work during the regular holiday shall be paid 200 percent of the wage for the first eight hours, computed as basic wage x 200 percent; and an additional 30 percent of the hourly rate for work done in excess of eight hours, or basic wage x 200 percent x 130 percent x number of hours worked.
“For work done during a regular holiday that also falls on the employee’s rest day, the employer shall pay an additional 30 percent of the basic wage of 200 percent for eight hours of work, computed as basic wage x 200 percent x 130 percent; and an additional 30 percent of the hourly rate, or hourly rate of the basic wage x 200 percent x 130 percent x 130 percent x number of hours worked, for work done in excess of eight hours,” Laguesma said.
For work done during a special nonworking holiday, an employee is entitled to an additional 30 percent of the basic wage on the first eight hours of work; 30 percent more of the hourly rate for work done in excess of eight hours; plus 50 percent of the basic wage on the first eight hours for work done during the special day that also falls on the employee’s rest day; and an additional 30 percent of the hourly rate for work done in excess of eight hours, computed as hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked. | CGC
