The Land Transportation Franchising and Regulatory Board (LTFRB) has ordered its Law Enforcement Unit to intensify anti-colorum operations nationwide against private trucks and vans illegally catering to online marketplaces and shopping platforms.
Acting LTFRB chairperson Greg Pua Jr. said in a statement Oct. 15 that legitimate operators raised the issue, which the agency’s investigation confirmed.
“This is a fair warning to all those involved in this modus. We have already started our operations against you in coordination with law enforcement agencies. Your only options so far are to stop or get the necessary permit for your operation,” Pua said.
He said the practice is considered colorum and is unfair to legitimate operators who comply with regulatory requirements.
Violations of Joint Administrative Order 2014-01 are punishable by impounding of the unit and a fine of up to P200,000 per unit.
Pua said securing a Certificate of Public Convenience (CPC) or valid authority from the LTFRB is not only about regulation but also road safety, since vehicles used for the purpose undergo roadworthiness inspections.
Under the Public Service Act, as amended by Republic Act 11659, this type of operation also requires ownership and control by Filipino citizens, following the constitutional limit of 60 percent to 40 percent ownership.
Violations of this requirement carry imprisonment of six years and one day to 12 years, or a fine not exceeding P2 million, or both.
“Let us make our country a better place to do business. And it starts with complying with the rules and regulations,” Pua said in a Philippine News Agency report.
“Otherwise, we will be forced to do it our way, and this means law enforcement. We in the LTFRB do not want it that way, so as much as possible, do your share on this aspect by respecting the existing rules and regulations on this matter,” he added. ||
