Bacolod Mayor Alfredo Benitez issued a cease-and-desist order (CDO) on the ongoing “simple embankment with slope protection” activity in a property owned by Home Invest Ventures Inc. in Purok Bayanihan, Barangay Banago in the city.
The CDO, dated Sept. 9 and made public Sept. 12, ordered the company, owned by Councilor Vladimir Gonzalez, from proceeding with the ongoing Embankment with Slope Protection Project pending inventory, verification, and land survey by the Department of Environment and Natural Resources.

“There is a need to verify the classification of the property and whether the activities being conducted thereon comply with applicable regulations on the particular class of land, as may be determined by the DENR and other government agencies,” Benitez said in the CDO, a copy of which was received by the company this afternoon, Sept. 12, as per the city Public Information Office.
Tension arose at the public hearing conducted by the Barangay Banago Council Sept. 8 to shed light on the activities conducted by the company of Gonzalez in the purok.
The barangay said the company is doing reclamation activities, while Gonzalez claimed that what they’re doing is an embankment project in their titled property.
Vice Mayor El Cid Familiaran also joined the public hearing regarding the request for a Resolution of No Objection (RONO) of Home Invest Ventures Inc. for the recovery of two properties involving an estimated 3.5 hectares along the shores of the barangay.
As per the CDO, the real properties involve Lot 2, PCS-06-001412 with TCT No. 092-2014004915, and Lot 1536 with TCT No. 092-2014004914.
There is a need to verify the property, as per DENR Department Order No. 2004-24, or the Revised Rules and Regulations Governing the Administration and Management of Foreshore Lands, and DENR Administrative Order No. 2007-29, or the Revised Regulations on Land Survey, the CDO said./CGC
